GENERAL RELEASE OF LIABILITY

NIXONSTUDIORENTAL

YOUR AGREEMENT IS FORMALLY AS FOLLOWS:

For the good and valuable consideration, receipt of which I hereby acknowledge, I hereby irrevocably and absolutely release and forever discharge Nixon Photographer, Nixon Studio Rental and its heirs, assigns, and designees, successors, personal representatives, affiliates, and any and all persons, firms or corporations liable or who might be claimed liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly denying liability, from any and all claims, demands, actions, causes of action or suits of any kind or nature whatsoever, which I now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages or any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the following: NIXON PHOTOGRAPHER, NIXON STUDIO RENTAL. It is understood and agreed that this Release contains the entire agreement between parties; and that the terms of this Agreement are contractual and not merely a recital. Furthermore, this Release shall be binding upon the undersigned and his representative heirs, executors, administrators, personal representatives, successors and assigns. This Release shall be subject and governed by the laws of the State of Massachusetts. I acknowledge that I have read and understood this release and that by booking my rental I have effectively signed and I have fully agreed to this release.

STUDIO RULES

  • All sessions are paid in full in advance.

  • Fees for additional time that was not billed during the initial booking will be due at the end of the session

  • ***Shooting time begins promptly at the prescribed starting time and ends promptly at the prescribed ending time, regardless if client and/or client’s party is late***

  • ***Session time includes setup, tear down and cleaning.***

  • $40 cleaning fee may apply for excessively dirty studio, large groups or production crews exceeding 15 people

  • $15 per hour additional charge for every hour booked after 8:00pm

 STUDIO GUIDELINES

  • No smoking is allowed in the studio. Projects involving smoke must have prior consent of Nixon Studio Rental

  • Music and volume is to be changed by Nixon Studio Rental only

  • No one will be admitted who is under the influence of alcohol or illegal substances

  • No pets allowed without prior consent of a company representative

  • All small and/or hard to clean material (confetti, hair cutting, feathers, food products, body paint, etc.) require approval from Nixon Studio Rental. Cleaning fee may apply

  • Maximum of 10 people in client’s party. Total 15 people max in the studio at one time. Additional fee of $5 per each person over the limit will apply 

  • ***All video footage to be edited for commercial use that is not simple selfie video requires a video rental fee of $100/hr. Video recorded without permission is subject to the fee being charged to the client’s card on file without additional notice.***

  • Photo shoots and non-selfie, portraits done by guests on cell phones or otherwise outside of the renter’s agreement are subject to an additional rental fee minimum of $25 and maximum of $55/hr charged to the client’s card on file. Random behind the scenes snapshots, selfies and cell phone videos are allowed.

POST PROCESSING AND PHOTO DELIVERY

  • Digital photos are delivered to the client via a Google Drive app link to the finished photos.

  • The amount of photos delivered depends on the length of the session and the amount of time spent teaching the client to pose in flattering angles. On average, a client who is not experienced in their best angles will produce 12-20 photos. Whereas, a client who understand their angles can produce from 40-60 photos.

  • All the photos are not delivered. The clients agrees they are hiring a professional to select and deliver only the best photos. The definition of a “best photo” is imply a photo where the client is not blinking, not pursing lips, the photo is not blurry and the pose and lighting is not unflattering.

  • Second looks are an additional $20 for every fifteen minutes of labor to deliver more photos than were originally delivered. Second looks are defined as the client requesting more photos after the Google Drive link has been sent and the job has been completed.

TAGGING, CREDITS AND PRINTING

  • The client must tag or mention or credit the photography on all social media, website or internet posts. This is because the photos are the sole property of the photography and the client does not own the photos. The client has paid merely to use the photographer’s technical and creative skill and labor to create or commission imagery.

  • The photos are the sole property of the photographer. As property protected under U.S. copyright law, the photos cannot be lawfully printed at any other retailer, such as Walmart, Walgreens, Target, CVS or any others. Please contact the studio or Nixon directly for prints at our state of the art lab. Our prints use special, pemium inks that will last 100 years.

CANCELLATION AND RESCHEDULING

  • No refunds for cancellation or no shows. Studio credit may be issued.

  • Clients are able to self-reschedule up to 16 hours prior or 180 days ahead.

  • There is no rescheduling fee.

  • Clients who may abuse studio services are subject to be banned.

FULL RENTAL AGREEMENT

The above constitutes the full rental agreement. This agreement applies to all studio sessions, go-see and visits. The General Release of Liability agreement applies to in-house bookings, as well as all studio rentals, go-see and visits.
